These Terms of Service ("Terms") govern your use of Kalocian (the "Service"), operated by Fortitude Design Inc. ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using it, you represent that you meet this requirement and that the information you provide is accurate.
2. The Service
Kalocian lets you create custom exercises and programs, log workouts, track progress, back up your data, and use optional community features. We may update, change, or discontinue features over time.
3. Your Account
You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly of any unauthorized use. You may delete your account at any time from within the app.
4. Subscriptions & Billing
The Service offers a free tier and a paid Premium subscription (currently $4.99/month or $39.99/year). Paid subscriptions are billed through Stripe and renew automatically unless cancelled beforehand. You can cancel anytime; cancellation takes effect at the end of the current period, and you keep Premium access until then. Except where required by law, payments are non-refundable. Prices and plan limits may change with notice.
5. Your Content & Data
You own the data and content you create in Kalocian. You grant us the limited rights necessary to host, store, back up, sync, and display your content to operate the Service for you. You can export a full copy of your data, or delete it, at any time. We do not claim ownership of your training data.
6. Acceptable Use
You agree not to misuse the Service, including by violating any law; infringing others' rights; uploading harmful or unlawful content; harassing other users; attempting to breach security, scrape, or disrupt the Service; or accessing it through unauthorized means. We may remove content or suspend accounts that violate these Terms.
7. Third-Party Services
The Service integrates with third parties such as Stripe, Google Drive, and Dropbox. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them. Connecting them is optional and within your control.
8. Health & Fitness Disclaimer
Kalocian is not a medical device and does not provide medical advice. The Service is a tool for tracking your own training. Exercise carries inherent risks. Consult a qualified physician before beginning any exercise program, and stop if you experience pain or discomfort. You are solely responsible for your training decisions and assume all risk associated with physical activity. We are not liable for any injury, health condition, or loss resulting from your use of the Service.
9. Intellectual Property
The Kalocian name, logo, software, and design are owned by us and protected by intellectual-property laws. These Terms grant you a limited, personal, non-transferable license to use the Service; they do not transfer any ownership to you.
10. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that data will never be lost. You are responsible for keeping your own backups, which the Service helps you do.
11. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim, or $50 if you paid nothing.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service. Sections that by their nature should survive termination (such as ownership, disclaimers, and limitation of liability) will survive.
13. Governing Law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. Any disputes will be resolved in the state or federal courts located in Wyoming, and you consent to their jurisdiction.
14. Changes to These Terms
We may update these Terms from time to time. We will revise the Effective date above and, for material changes, provide additional notice. Continued use after changes take effect constitutes acceptance.
